Agreement between the Republic of Azerbaijan and the European Union on simplification of visas

The Agreement between the Republic of Azerbaijan and the European Union on the simplification of visa clearance entered into force on September 1, 2014. (hereinafter "Agreement"). The purpose of this Agreement is to simplify the issuance of visas for citizens of the member states of the European Union (hereinafter "EU") and the Republic of Azerbaijan for a period of no more than 90 days in every 180 days based on the principle of reciprocity.

The visa simplifications established by the aforementioned Agreement apply to citizens of the following EU member states:

 

 

Austria, Belgium, Bulgaria, Croatia Cyprus Czech Republic, Estonia, Finland, France, Germany, Greece, Hungary ,İ

Italy, Latvia, Lithuania, Luxembourg Malta Malta Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden

                      

Note: The visa simplifications established by the Agreement mentioned above do not apply to citizens of the Kingdom of Denmark, the Republic of Ireland and the United Kingdom.

 

The agreement defines the following simplifications:

 

1. Registration of multiple entry visas

 

Citizens of the following categories of EU member states and the Republic of Azerbaijan may apply to the diplomatic missions and consulates of the member states and the Republic of Azerbaijan for multiple entry visas valid for 5 years:

a) Husband or wife visiting citizens of the European Union legally residing in the territory of the Republic of Azerbaijan or citizens of the Republic of Azerbaijan legally residing in the Member States or citizens of the European Union residing in the territory of the Member State of which they are citizens or citizens of the Republic of Azerbaijan residing in the territory of the Republic of Azerbaijan, aged 21 and over inferior or dependent children (including adoptees) and parents (including guardians);
b) Permanent representatives of official delegations who must regularly participate in meetings, consultations, negotiations or exchange programs, as well as in events organized by intergovernmental organizations on the territory of the Republic of Azerbaijan or one of the Member States, based on an official invitation addressed to the Member States, the European Union or the Republic of Azerbaijan. members;
Note: The validity of a multiple-entry visa will be limited to that period if the intention to visit regularly or regularly is clearly limited to a shorter period, especially if:

In the case of the persons referred to in point (a), the validity period of legal residence permits of citizens of the Union or citizens of the Republic of Azerbaijan legally residing in the Republic of Azerbaijan or one of the Member States;

In the case of persons referred to in paragraph (b), if the period of validity of the status of a permanent member of the official delegation is less than five years.

Citizens of the following categories of EU member states and the Republic of Azerbaijan who have obtained at least one visa during the previous year and have used it in accordance with the rules of entry and stay of the state they visited, diplomatic missions of the member states and the Republic of Azerbaijan for the registration of multiple entry visas with a validity period of one year and can apply to their consulates:

a) students and doctoral students who regularly travel for the purposes of training or educational courses, including exchange programs;
b) journalists and technical staff accompanying them at a professional level;
c) participants of official exchange programs organized by sister cities;
d) Drivers who perform international cargo transportation and passenger transportation services between the territories of the Republic of Azerbaijan and the territories of the Member States on vehicles registered in the Member States or the Republic of Azerbaijan;
e) persons who need to travel regularly for medical purposes and persons accompanying them due to necessity;
f) Holders of qualifications who regularly visit the Republic of Azerbaijan or Member States and participate in international exhibitions, conferences, symposiums, seminars and other similar events;
g) representatives of civil society organizations regularly traveling to the Republic of Azerbaijan or Member States for the purpose of educational courses, seminars, conferences, including exchange programs;
h) Persons who regularly visit the Republic of Azerbaijan or Member States, participate in scientific, cultural and artistic events, including university and other exchange programs; .
i) participants of international sports events and persons accompanying them at a professional level;
j) Members of official delegations who must regularly participate in meetings, consultations, negotiations or exchange programs, as well as in events organized by intergovernmental organizations on the territory of the Republic of Azerbaijan or one of the Member States, based on an official invitation addressed to the Member States, the European Union or the Republic of Azerbaijan ;
k) Businessmen and representatives of commercial organizations who regularly visit the Republic of Azerbaijan or the Member States.
Note: if the intention to visit regularly or regularly is clearly limited to a shorter period, the validity of the multiple-entry visa will be limited to that period.

 

2. Documentary basis confirming the purpose of the trip

 

For citizens of the Union and the Republic of Azerbaijan of the following categories, the following documents are sufficient to justify the purpose of the visit to the other Party:

(a) European Union legally residing in the territory of the Republic of Azerbaijan
citizens or citizens of the Republic of Azerbaijan legally living in the Member States or citizens of the European Union living in the territory of the Member State of which they are citizens or close relatives visiting citizens of the Republic of Azerbaijan living in the territory of the Republic of Azerbaijan - husband or wife, children (including those adopted), parents (including guardians), for grandparents and grandchildren:

- written application of the receiving person;

(b) without prejudice to Article 10, in official meetings, consultations, negotiations or exchange programs based on an official invitation addressed to the Member States, the European Union or the Republic of Azerbaijan, including by intergovernmental organizations of the Republic of Azerbaijan or
For members of official delegations, including permanent members of such delegations, who will participate in events organized on the territory of one of the Member States:

- accompanied by a copy of the official invitation issued by the competent authority of the Member State or the Republic of Azerbaijan or any institution of the European Union, confirming that the applicant is a member of the delegation or a permanent member of the delegation visiting the territory of the other Party to participate in the above-mentioned event the letter;

(c) for businessmen and representatives of commercial organizations:

- trade and industry carried out in the territory of the receiving legal entity or company, organization or office or branch of such a legal entity or company or the state or local authorities of the Republic of Azerbaijan or the Member States, or the Republic of Azerbaijan or one of the Member States the written application of the organizing committees of exhibitions, conferences and symposia approved by the relevant competent body in accordance with national legislation;

(d) For drivers who carry out international cargo transportation and passenger transportation services between the Republic of Azerbaijan and the territories of the Member States on vehicles registered in the Republic of Azerbaijan or in the Member States:

- a written application of the national cargo transport company or association (union) of the Republic of Azerbaijan, which provides international road transport, or the national cargo transport associations of the Member States, reflecting the purpose, route, duration and regularity of the trips;

(e) for pupils, students, doctoral students and accompanying teachers traveling for training or study courses, as well as school-related activities, including exchange programs:

- a written application of the receiving university, academy, institute, college or school or a certificate of acceptance or a student card or a certificate of participation in courses;

(f) for persons participating in scientific, cultural and artistic events, including university and other exchange programs:

- written request of the receiving organization for participation in these events;

(g) for journalists and their professional accompanying technical staff:

- a certificate or other document issued by a professional organization or the applicant's employer, proving that the person in question is a qualified journalist and that the purpose of the trip is the performance of journalistic work, or that he is a member of the technical staff accompanying the journalist at a professional level;

(h) for participants of international sports events and persons accompanying them at a professional level:

- A written request of the receiving organization, competent authorities, national sports federations of the Member States or the Republic of Azerbaijan and the National Olympic Committee of the Republic of Azerbaijan or the national Olympic committees of the Member States;

(i) for participants in official exchange programs organized by sister cities:

- written application of heads of executive authorities/mayors of these cities;

(j) for persons traveling for medical purposes and persons accompanying them as necessary:

- the official document of the medical institution confirming the need for medical treatment and accompanying and a confirmation document that there are sufficient funds to pay for the medical treatment;

(k) For holders of qualifications participating in international exhibitions, conferences, symposiums, seminars and other similar events held in the territory of the Republic of Azerbaijan or Member States:

- a written request of the receiving organization confirming the participation of the mentioned person in that event;

(l) for representatives of civil society organizations traveling to participate in training courses, seminars and conferences, including exchange programs:

- a written application submitted by the receiving organization, a document confirming the person's representation of a civil society organization, and an extract from the state register of this organization's registration issued by the relevant state body in accordance with national legislation;

(m) relatives traveling for funerals:

- the fact of death, as well as an official document confirming the family or other kinship between the applicant and the buried person;

(n) for visiting military and civilian cemeteries:

- an official document confirming the existence and stay of the grave, as well as the family or other kinship between the applicant and the buried person;

Note: An appropriate written request must include the following items:

a) for the invited person: name and surname, date of birth, gender, citizenship, passport number, time and purpose of the trip, number of entries and, if necessary, the names of the spouse and children who will accompany the invited person;
b) for the inviting person: name, surname and address;
c) for the inviting legal entity, company or organization: full name and address and:
- if the application is made by an organization or an authorized body, the name and position of the person who signed the application;
- if the inviter is a legal entity or company established in the territory of the Member State or the Republic of Azerbaijan, or an office or branch of such a legal entity or company, the registration number required by the relevant national legislation of the Member State or the Republic of Azerbaijan.

3.Viza ərizələrinə baxılması üçün rüsumlar

 

The fee for processing visa applications is 35 euros.

The following categories of persons are exempted from the visa application processing fee:

(a) Close relatives of citizens of the European Union legally residing in the territory of the Republic of Azerbaijan or citizens of the Republic of Azerbaijan legally residing in the Member States or citizens of the European Union residing in the territory of the Member State of which they are citizens or citizens of the Republic of Azerbaijan residing in the territory of the Republic of Azerbaijan - husband or wife, children ( (including adoptees), parents (including guardians), grandparents and grandchildren;

(b) Members of official delegations who will participate in official meetings, consultations, negotiations or exchange programs, as well as in events organized by intergovernmental organizations on the territory of the Republic of Azerbaijan or one of the Member States, based on an official invitation addressed to the Member States, the European Union or the Republic of Azerbaijan, including permanent members;

(c) pupils, students, doctoral students and accompanying teachers traveling for educational or training courses, as well as other school-related activities, including exchange programs;

(d) disabled persons and, if necessary, accompanying persons;

(e) participants of international sports events and persons accompanying them at a professional level;

(f) persons participating in scientific, cultural and artistic events, including university and other exchange programs;

(g) persons presenting documents proving the necessity of their travel on humanitarian grounds, including to receive emergency medical treatment, or to attend the funeral of a relative, or to visit a close relative who is seriously ill, and those accompanying such persons;

(h) representatives of civil society organizations traveling for educational courses, seminars, conferences, including exchange programs;

(i) retirees;

(j) children under 12 years of age;

(k) journalists and their professional accompanying technical staff.

Note: Where a Member State or the Republic of Azerbaijan cooperates with an external service provider for visa processing, the external service provider may charge a fee for the services. This fee shall be proportionate to the costs incurred by the external service provider in the performance of its work and shall not exceed EUR 30. Member States and the Republic of Azerbaijan should maintain the possibility for applicants to submit their applications directly to their consulates.

 

4. Duration of visa application processing procedures

 

Diplomatic missions and consular units of the Republic of Azerbaijan make a decision on the visa application within 10 calendar days from the date of receipt of the visa application and required documents. The period for making a decision on a visa application can be extended up to 30 calendar days in individual cases, especially if there is a need for further investigation of the application.

Note: If applicants are required to make an appointment to submit their application, the appointment will normally take place within two weeks of the date of the appointment request. Notwithstanding the preceding sentence, external service providers ensure that visa applications are normally submitted without delay. In justified cases of urgency, the consulate may allow the applicant to submit his application without an appointment or an appointment will be made immediately.

 

5. Diplomatic passports

 

Citizens of the European Union and the Republic of Azerbaijan who have valid diplomatic passports can enter, leave and transit through the territory of the Republic of Azerbaijan or the Member States without a visa for no more than 90 days in every 180 days.

 

6. Other issues

 

According to Article 2.2 of the Agreement, the national legislation of the Republic of Azerbaijan or the Member States or the laws of the Union shall apply to matters not regulated by the provisions of the Agreement (such as refusal to issue a visa, recognition of travel documents, proof of sufficient funds for living, entry ban and removal measures). is done.
